Leveraging Technology

We have used various software and computer hardware to present arguments, exhibits, and graphics at trials and hearings:
  • The flawed business contract. TRIALPAD (trademark of LitSoftware), PowerPoint and Word (Microsoft) and Camtasia Studio and Snagit (TechSmith). To present our client's claim that, due to a drafting error, a contract provision did not accurately reflect the mutual agreement of the parties, we presented exhibits to the court on a 60" monitor from an iPad Pro (Apple). Paper versions of the exhibits were also made available whenever the electronic presentation slowed the pace of a witness examination. We created and presented a 3 minute desktop video that showed the drafting error in its native, track-changes format, including the date and time on which it was created. The burden of proof in such cases is "by clear and convincing evidence". The court ruled in our client's favor.
